Judge reduces bail for teenager accused of rape

WOODSTOCK – A local judge has reduced bail for a 17-year-old Crystal Lake boy accused of raping an 18-year-old during an underage drinking party in Oakwood Hills.

McHenry County Judge Sharon Prather on Thursday reduced the bail for Joseph Wilson from $80,000 to $50,000, which requires posting $5,000 for release. Defense attorney David Franks had asked her to release him on his own recognizance or to allow him to post a small, but unspecified, amount.

Wilson remained in custody Thursday afternoon.

Prosecutors objected to the reduction, but Franks argued that Wilson was not a flight risk and had no history of violence.

“The police responded to an underage drinking party, and that’s when these allegations arose,” Franks said.

The alleged victim told police that Wilson had come into the bedroom where she was sleeping Oct. 10, removed her clothing, and forced sex on her as she shouted loud enough for others to hear outside the bedroom, Assistant State’s Attorney Kirk Chrzanowski said. The alleged victim told police she repeatedly told him to get off her and heard people pounding on the locked bedroom door as he held her down, Chrzanowski said.

Wilson and the alleged victim attended the same high school but never dated, Chrzanowski said.

Franks reminded Prather that those merely were allegations against his client.

Wilson has struggled with substance abuse and ADHD, and his father arranged for him to attend in-patient treatment if he is released, Franks said.

If Wilson is able to post the lower bail, he must continue GED classes, follow a curfew, consume no alcohol or drugs, and have no contact with the alleged victim, Prather ruled. The case is next due in court Nov. 12.
